Hello everyone! This week I will be giving you advice regarding Immigration's Request for Evidence, also known as "RFE". Although I have covered this topic in the past, that was in regards to the filing of your taxes and how that can be evidence of a bona-fide marriage. In this article, however, I will be giving you practical pointers on how to respond to the RFE.

If you receive a Request for Evidence (or Request for Additional Evidence) notice from USCIS, I advise the following:

(1) Understand the Request: Read the letter carefully and make sure you understand what they want from you. This may sound easy enough but I have seen a lot of people submitting the wrong things, such as sending something USCIS did not ask for, or failing to send what they did ask for!

Example: If Immigration is requesting A, B, C and D... make sure you do not send them A, B, C and E.

(2) Note the Deadline: Look at the due date and make sure you submit everything before this deadline. If USCIS receives your evidence after the deadline, they may reject your submission and base their decision on what is already in your file.

(3) Correct Mailing Address: Send your evidence to the right place. Usually the address to send your documents is located on the last page, and is not necessarily the one listed on the envelope they use to mail you the notice. If you receive a letter with your RFE, then use that return envelope if you can. If not, address your envelope accordingly.

A client recently received an RFE letter from USCIS requesting additional evidence of a good faith marriage ("Bona-fide" Marriage Documents). In response to this request, I sent them 252 pages of additional evidence!!!

Let's say Immigration needs proof of your bona fide marriage but you and your spouse do not have much.

Q: What should you do? What do you do if you only have 2 or 3 pieces of evidence?
