Future Wives often say “I trust him” to do the right thing in the future. If that is the case, the Husband should trust the Wife as well. It is understandable, and reasonable, that a Husband might want to protect his property for his children from an earlier marriage. There are easy ways to do that, ways that do not require that a future Wife give up a lot of rights or put herself–and future children–in danger of poverty, destitution, and homelessness in the event of death, disability, or divorce.

คำแนะนำหลักๆ STRONG RECOMMENDATIONS

1. ทั้งสามีและภรรยาควรปรึกษากัน (แล้วเขียนบันทึกเป็นหลักฐานว่าได้ปรึกษากันแล้ว) ว่าจะมีการทำข้อตกลงก่อนการสมรสเป็นเวลานานพอสมควรก่อนวันที่จะจดทะเบียนสมรส ถ้าเป็นไปได้ให้เจรจากันก่อนที่ภรรยาจะทิ้งบ้านเกิดเมืองนอน (ทิ้งงานและอื่นๆ) เพื่อที่จะมาอเมริกา

2. ถ้าเป็นไปได้ วิธีที่ดีที่สุดคือควรให้ทั้งสองฝ่ายมีทนายความที่มีความรู้และประสบการณ์ด้านนี้ที่เมืองไทย (หรือที่ประเทศอื่น) เพื่อตรวจดูเนื้อหาที่เสนอมาในข้อตกลงก่อนการสมรส แล้วให้ทนายความพูดคุยกับฝ่ายภรรยาก่อนเป็นภาษาไทย (หรือภาษาอื่นที่เป็นภาษาที่ฝ่ายภรรยาถนัด) วิธีที่ดีรองลงมาคือให้แปลข้อตกลงก่อนการสมรสนั้นเป็นภาษาไทยโดยผู้แปลที่มีคุณวุฒิ (ในเขตเมืองซานฟรานซิสโก ค่าแปลตกประมาณหน้าละ 40-60 เหรียญสหรัฐและใช้เวลาประมาณหนึ่งสัปดาห์)

3. ถ้าเป็นไปได้ ฝ่ายภรรยาควรจัดหาทนายและจ่ายเงินค่าทนายด้วยตนเอง อย่างน้อยฝ่ายภรรยาควรเป็นผู้ได้รับเงินจากฝ่ายสามีแล้วนำเงินนั้นไปจ่ายค่าทนายด้วยตนเอง ผู้เป็นภรรยาไม่ควรใช้ทนายความที่เป็นเพื่อนของสามีหรือผู้ที่เคยเป็นทนายให้กับสามีมาก่อน

8. ข้อควรจำ ถ้าทั้งสองฝ่ายอาศัยอยู่ด้วยกัน (ซึ่งกรณีส่วนใหญ่จะเป็นเช่นนั้น) ก็เป็นที่เข้าใจว่าความไว้วางใจนั้นจะมีต่อกันและกันมากกว่าที่จะมีให้กับทนายความของตน จะต้องไม่มีความลับต่อกัน จะต้องมีการคุยกันฉันคู่รักอย่างหวานชื่น ฝ่ายที่มีอำนาจในการต่อรองมากกว่า (ส่วนมากจะเป็นฝ่ายสามี) จะพูดกล่อมให้ฝ่ายภรรยาที่สามารถทำให้คำแนะนำของทนายความฝ่ายภรรยาลดความสำคัญลง ภรรยาก็จะเชื่อฝ่ายสามีมากกว่าเชื่อทนายความของตน ความสัมพันธ์ของภรรยากับทนายความของเธอก็จะลดความสำคัญลงด้วย ฝ่ายสามีมักจะบ่นว่าทนายความชอบทำให้เรื่องซับซ้อนและยืดเยื้อ ดังนั้นผู้เป็นภรรยาและทนายความของเธอควรคำนึงถึงจุดนี้ด้วย

9. สิ่งสำคัญที่ควรจำ สำหรับทนายความ ผู้เป็นสามีและผู้เป็นภรรยาทั้งหลาย ถ้าเข้าใจกันหรือตกลงกันไม่ได้หรือเข้าใจแต่เพียงเล็กน้อยตอนที่เซ็นข้อตกลงก่อนการสมรส เท่ากับว่าไม่มีการเข้าใจร่วมกันและถือว่าไม่มีการทำข้อตกลงจริงๆ นั่นก็คือ ข้อตกลงนั้นศาลอาจจะตัดสินให้เป็นเอกสารโมฆะ(เอกสารนั้นใช้ไม่ได้) แต่ก็ไม่สามารถรับประกันได้ว่าศาลจะตัดสินให้เอกสารนั้นเป็นโมฆะเสมอไป แต่ถ้าศาลตัดสิน สิทธิของทั้งสองฝ่ายก็จะไม่ได้รับการปกป้องตามที่ตนต้องการ


1. Husband and Wife should discuss (with writings as evidence they did so) the idea of a Pre-Marital Agreement long before any marriage date is set. Preferably, before the Wife severs ties at home (quits job, etc.) and comes to the US.

2. Best possible of all worlds, the parties should have a qualified lawyer in Thailand (or other home country) the examine the proposed Pre-Marital Agreement first and discuss it with Wife in Thai (or other native language). Second best, get the Agreement translated into Thai by qualified translator. (In the San Francisco area, this should run about $40-60 per page–turn around time about a week).

3. If possible, Wife should arrange for and pay for her own lawyer. At the very least the payment should go through Wife’s hands. Wife should not use a lawyer who is a friend of the husband or who has previously represented husband.

4. This is important for the clients and for the lawyers:----Depending on circumstances, the lawyer (especially the lawyer for the non-earning or lower income party) should make clear before being hired that his job is to represent the interests of his client and to approve of the agreement, or to withhold approval if his client is not protected; that his job is NOT just to read and explain a draft Pre-Marital Agreement and sign off on it, no matter what it says. For the lawyer, I have recently come to recommend that the he should also make clear in writing, before being retained, that he will not approve any agreement that calls for a waiver of support or for severe limitations on support. Otherwise, clients may not take this warning seriously. This is necessary as clients are often in a rush to get married and there is a lot of pressure (because of immigration requirements, for example) to sign an agreement as soon as possible in order to get married on schedule. The clients must understand approval is not automatic and may not be forthcoming at all, especially where a waiver of support is involved.

5. There should be no rush; preferably no wedding date set. Certainly, there should be a minimum of 45-60 days from start to expected finish date. It is important to note that the parties are required by law to have the final version of the Agreement in their hands a week prior to signing it; no changes after that and before signing. Estimate 20-30 hours of lawyer time (or more) for negotiations and drawing up the papers. Expect to pay up-front, about $7,500. Be sure that any unearned portion of this payment is to be refunded if not earned. Also, be aware that the charges may be substantially higher than this.

6. An interpreter should be on call (if needed), ready to be involved at short notice all during the process. A court certified interpreter should be present for important meetings. Consider video record meetings. For example, my Thai is sufficient for conversational purposes. But, to protect myself, I would--at least at some late stage--have a court certified interpreter involved, probably at review of the last draft. This review will probably take 2- 4 hours or longer.

7. For both the lawyer and the client, a "cross-cultural advisor" should be involved. In my case, this is part of my role along with my wife Nattaya. Thais, and Thai women in general, are very likely to indicate understanding and agreement when that in fact is not the case. They are also very likely to be self-effacing and overly diffident, by American standards (too polite and too willing to give things up-- not to make a “fuss”). Without thorough understanding and “internalizing" of their rights or with a desire not to "upset things" they may not make known their concerns to their lawyer or take steps in advance to protect themselves. Husbands need to understand this as well.

8. REMEMBER: If, as is usually the case, the parties are living together, their loyalty (understandably) may very well be to each other rather than to their lawyers. There will be no secrets. They will have “bedroom talk”; what Americans call “pillow talk”. The spouse in the stronger bargaining position (usually the Husband) will be in an excellent position to undermine Wife’s relationship with her lawyer and the advice the lawyer is giving her. This is often done often by complaining that the lawyer is making things too complicated and taking too long. Both the Wife and her attorney have to be aware of this.

9. IMPORTANT TO REMEMBER; FOR LAWYERS, HUSBANDS, AND WIVES. If there is little or no understanding of what is in the Pre-Marital Agreement when it is signed, there is no meeting of the minds and no real contract. I.e., the Agreement may possibly be thrown out later by the court for this reason. There is no guarantee that it will be thrown out but if it is, then neither party’s rights will be protected as they intended.
